Bis FMCS License Requirements and Regulations for 2024

Since 2000, under the BIS Act, 2016 and Rules & Regulations framed under BIS (Bureau of Indian Standards) been operating a Foreign Manufacture Certification. It is granted to Foreign Manufacturers for the use of a Standard Mark on a product that confirms an Indian standard. FMCS scheme is applicable to all products except the Electronics & IT Goods notified by MeitY. 

BIS FMCS licensee is granted by the Foreign Manufacturers Certification Department located at BIS Headquarters in New Delhi.

It is mandatory to obtain FMCS on products under the purview of the BIS (Bureau of Indian Standards). If your product is not FMCS certified, you will lose access to your products in the Indian market.

FMCS Certification Products List

  • Sulphate Resisting Portland Cement
  • Masonry Cement
  • White Portland Cement
  • AC static transformer operated watt-hour and VAR-hour meters, class 0.2S & 0.5S
  • Switches for domestic and similar purposes
  • Food for Special Medical Purposes intended for Infants
  • Welded low-carbon steel cylinders for low-pressure liquefiable gases not exceeding 5-litre water capacity
  • Low-pressure regulators for use with liquefied petroleum gas (LPG) mixtures
  • Galvanized steel sheets (plain and corrugated).
  • Steel plates for pressure vessels used at moderate and low temperature

BIS Rules and Regulations

The Bureau of Indian Standards Act, 2016, has been implemented since October 12, 2017. The highlights of the BIS Act are listed below:

  • BIS position as National Standards Body.
  • It permits multiple conformity assessment schemes with global practices.
  • Allows the Government to authorize any agency apart from BIS to certify and enforce conformity to a standard.
  • It permits the government to include the products under mandatory certification on the grounds of health, national security, safety, environment, and prevention of deceptive practices.
  • It enables the Government to bring hallmarking of precious metal articles under mandatory certification.
  • It consists of consumer protection measures such as recalls of non-conforming standard-marked items, compensation for consumers, and more strict penal provisions.

Documents Required for FMCS:

  • Quality control manual
  • ISO certificate
  • The list of machinery used for manufacturing
  • According to Indian Standard, an in-house test report shall be required
  • A business license shall be required with the scope of business
  • The list of testing equipment with calibration certificate
  • The list of raw materials used and the supplier certificate
  • Nomination of Indian representative
  • The Process of flow chart
  • Agreement between manufacturer and AIR
  • Process of inspection report
  • For the authorized signatory, CEO authorization would be required
  • The list of quality test teams, along with their qualification certificate and appointment letter.

Procedure for FMCS Certification

  • The procedure shall begin by checking the eligibility of the manufacturer. 
  • Next, an evaluation and examination of the manufacturing unit and product shall take place.
  • As per the requirement, we can administer the pre-audit to ensure that everything is available. 
  • Ensure that the manufacturer has all the documents.
  • Fill out the entire application form and attach the required documents.
  • Pay the fees for the application form.
  • The in-house inspection takes place and is sent to a laboratory for evaluation by the BIS officer. The product gets sealed.
  • Next, the manufacturer has to pay marking fees as applicable to the product. A CML number (grant letter) will be issued to the manufacturer.
  • When AIR signs the agreement with BIS, the manufacturer must deposit a $10,000 (USD) Performance Bank Guarantee (PBG) in favor of BIS at a bank with an Indian branch.
  • Once BIS receives the PBG, licensing documentation will be sent to the manufacturer.
